This website privacy policy (“Privacy Policy”) describes our online privacy practices with respect to the use and disclosure of information we may collect from you when you access the Site and any other websites or applications that may link to this Privacy Policy (collectively, our “Services”). Scope of This Privacy Policy

This Privacy Policy applies to your use of Dr. Wright’s public facing website, https://drmaryjowright.com. This privacy statement also applies to information shared with us by our approved partners and other third-party sources.

This Privacy Policy does not apply to information collected through other means, such as by telephone or in person. This Privacy Policy does not apply to information collected by any third party that may link to or be accessible from or on the Site. 

Acceptance of This Privacy Policy

This Privacy Policy governs your access to and use of this Site. Please read this Privacy Policy carefully before you start to use this Site. By accessing or using this Site, you accept and agree to this Privacy Policy and consent to the collection, use, and sharing of information as described in this Privacy Policy. If you do not agree to this Privacy Policy, then you should not access or use this Site. 

Information We Collect About You and How We Collect It

We collect several types of Personal Information from and about users of the Site. As used in the Privacy Policy, “Personal Information” includes information that may be used, either alone or in combination with other information, to personally identify an individual, such as name, postal address, email address, and telephone number; information that is about you but individually does not identify you; and/or information about your internet connection, the equipment you use to access the Site, and usage details. We collect Personal Information in three ways: directly from you when you voluntarily provide it to us; from our web server logs; and/or with cookies and web beacons. 

Information You Provide Us Voluntarily

We collect and store personally identifiable information that you voluntarily provide to us through this Site when you use Site features such as contact requests. This information may include your name, email address, phone number, postal address, insurance information, copies of correspondence you send through the Site, details of transactions you carry out through our Site and of the fulfillment of orders, and other information you choose to provide through use of our Site. We will use your information to fulfill the purpose for which you provide it and for our business operations. 

Occasionally we may request feedback on this Site to better understand how we can improve what information we present and how we present it. These surveys do not ask questions that could personally identify you. We may ask for contact information to follow up, but you can decline to provide that information. Information that you provide in a survey may be shared with employees or third parties to aggregate the data. 

Email communications that you send to us via the email links on our Services may be shared with a customer service representative, employee, medical expert, or agent that is most able to address your inquiry. The email functionality of our Services does not provide a completely secure and confidential means of communication. It is possible that your email communication may be accessed or viewed by another Internet user while in transit to us. If you wish to keep your communications private, do not use our email. 

Information We Collect Automatically

As you interact with this Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns in order to administer our Services and analyze Site usage. The information we collect automatically does not include information by which we may identify you individually. Examples of information we may track include, without limitation, your Internet protocol (“IP”) address; the kind of browser or computer you use; the number of links you click within our Services; the state or country from which you accessed our Services; the date and time of your visit; the name of your Internet service provider; third party websites you linked to from our Services; and pages or information you viewed on our Services. 

We use this information to analyze and improve our Services, monitor traffic and usage patterns for information security purposes, and to help make our Services more useful. We also may use the information we automatically collect to direct related advertisements and/or informational content to Site users when they visit other websites.

Cookies and Web Beacons:

Cookies are small data files that online services can store on, and retrieve from, a user’s computer or mobile device through the user’s web browser. The information is stored and retrievable either for the duration of a website visit (known as “session cookies”), or until some later point in time set by the website setting the cookie (known as “persistent cookies”). We use session cookies and persistent cookies to tailor web content to match your browser capability. Cookies allow the Site to retain information to make your use of the Site more convenient.

Most internet browsers accept cookies by default, but you can modify your browser preferences to block or restrict cookies if you do not want your web browsing activity tracked. We are not responsible for the effectiveness or compliance of third-party opt-out mechanisms or programs. Please note that if you delete your cookies or upgrade your browser after having opted out, you will need to opt out again. Further, if you use multiple browsers or devices, you will need to opt out on each browser or device. You can access the information on this Site without enabling cookies in your browser, but disabling cookies may result in a diminished ability to take advantage of the services and related informational content on this Site.

A “web beacon,” “clear GIF,” “web bug,” or “pixel tag” is a tiny graphic file with a unique identifier that is similar in function to a cookie, but would allow us to count the number of users that have visited certain pages or screens of our Site, and to help determine the effectiveness of promotional or advertising campaigns. When used in HTML-formatted email messages, web beacons can tell the sender whether and when the email has been opened. In contrast to cookies, which may be stored on your computer’s hard drive, web beacons are typically embedded invisibly on pages or screens. We may use web beacons in providing the Services. 

Geolocation Data

We do not collect precise information (e.g., GPS data, latitude and longitude) concerning the location from which you access the Services, but we collect information on your region and postal code to help us gather information useful for improving the relevance of our content and securing our Services. 

Third-Party Use of Cookies and Other Tracking Technologies

We may display content from third party platforms or services that allow you to view their hosted content directly from the pages of our Site and interact with them. We do not control these third parties’ tracking technologies or how they may be used. These third parties may use cookies, alone or in conjunction with web beacons and other tracking technologies, to collect information about you when you use the Site. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based advertising or other target content. 

For example, we use YouTube, a video sharing and social media platform provided by Google LLC, to embed video content on our Site. Google’s Privacy Policy explains how YouTube/Google treat your personal data and protect your privacy when you provide your personal data in connection with your access and use of their services.

Advertising

We do not use third party advertising to serve ads to you when you access our Services. 

We use Google Ads, the Google Marketing Platform and related marketing and advertising services provided by Google, LLC in connection with our Site and general corporate advertising and marketing operations for purposes of, among other things, online advertising of our services, which includes remarketing, re-engagement, or similar audience and advertising and marketing features. You can control the information Google uses to show you ads by changing your Google Ad Personalization Settings. We use Facebook Ads and related services provided by Facebook, Inc. in connection with our Site to run advertising and marketing campaigns on Facebook. Facebook’s Cookie Policy explains how Facebook uses data to show you ads and how you can control usage.

How We Use the Information We Collect

We may use your information to:

  • Provide services, operate the Site, and help us improve the services we offer and the Site.
  • Personalize your experience and inform you about the treatments/services in which you have indicated an interest. 
  • Improve the Site offerings and send you information and updates.
  • Respond to your questions and requests and improve customer service.
  • Administer a promotion, survey, or other site feature.
  • Provide you with certain services or information you request, such as sending you our newsletters.
  • Protect our rights or our property to ensure the technical functionality and security of our Services.

We collect information from you where we need it to perform our contract with you (i.e., our Terms); where the processing is in our legitimate interest such as securing and improving our Services, for example (provided these are not overridden by your interests or rights); where the processing is for the provision of healthcare or the management

How We Disclose the Information We Collect

We do not sell, lease, rent, or otherwise disclose the Personal Information collected from our Site to third parties unless otherwise stated below or with your consent. 

We may disclose the information you provide to us or which we collect about you to third parties in the following circumstances:

  • We may disclose the information to our subsidiaries and affiliates. 
  • We may disclose the information to contractors and service providers who we have engaged to help us provide services or operate the Site. For example, we may use third party service providers for security, website analytics, or payment processing.   • If the ownership of our business changes or we need to transfer assets relating to this Site to a third party, we may transfer the information to the new owner.

Data Security

We are committed to protecting the privacy of the personal information you provide to us via this Site and that we collect. We use industry accepted physical, electronic, and procedural safeguards to prevent unauthorized access to your information, including a secure firewall and a security infrastructure that protects the integrity and privacy of personal information submitted to us via this Site. 

Although we work hard to protect your personal information, no website can guarantee the security of any information you transmit to us through online applications. If you choose to send any personal information to us, you accept the risk that a third party may intercept and use the information. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. 

Data Retention

We will retain your Personal Information for as long as needed to provide you services, comply with our legal obligations, resolve disputes, enforce our agreements, and as otherwise needed to fulfill the purposes for which it has been collected as described in this Privacy Policy, unless a longer retention period is required by law (e.g., laws mandating retention of medical records for a certain period of time).

Third Party Websites and Payments

If you use the Site to link to another third-party website, you may decide to disclose personal information at that website. In contacting that third party website, or in providing information to that website, that third party may obtain personal information about you. This Privacy Policy does not apply when you leave the Site and go to a third-party website. We encourage you to be aware when you leave the Site and to read the privacy statements of each third-party website that collects personal information. 

Any payments you make for services you have found on the Site are made exclusively through a third-party website, and that third party’s separate privacy policy applies. We are not responsible for any fees, charges, or actions by such third-party website. 

Rights of California Residents

If you are a California resident, California law may provide you with additional rights regarding our use of your Personal Information.

California Direct Marketing Privacy Rights

Under California’s “Shine the Light” law (Civil Code § 1798.83), California residents have the right to request in writing from businesses with whom they have an established business relationship (a) a list of the categories of personal information, such as name, email and mailing address and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes; and (b) the names and addresses of all such third parties. To request the above information, please contact us at [email protected] with a reference to California Disclosure Information. We will endeavor to respond to such requests to information access promptly, but not to exceed 150 days from the date received. Please note that we are only required to respond to each customer once per calendar year. 

California and Delaware “Do Not Track” Disclosures

California and Delaware law require us to indicate whether we honor “Do Not Track” settings in your browser concerning targeted advertising. At this time, there is no worldwide uniform or consistent industry standard or definition for responding to, processing, or communicating Do Not Track signals. Thus, like many other websites and online services, we do not currently respond to any Do Not Track browser requests. 

Rights Under the California Consumer Privacy Act of 2018 (“CCPA”)

For purposes of this section only, “Personal Information” means information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or household.

Consumers residing in California have the following rights: 

  • Right to Request Information. Consumers have the right to request that we disclose the following information to you, limited to the preceding twelve (12) months:
    • The categories of Personal Information that we collected about you.
    • The categories of sources from which the Personal Information is collected.
    • The business or commercial purpose for collecting or selling Personal Information. 
    • The categories of third parties with whom we share Personal Information.
    • The specific pieces of Personal Information that we disclosed about you for a business purpose or sold to third parties; and
    • For each category of Personal Information, the categories of third parties to whom the information was disclosed or sold.

Please note, under California law, we are only required to respond to such requests from each Consumer twice in a twelve (12) month period.

  • Right to Deletion. Consumers have the right to request that we delete any Personal Information about you which we have collected from you. Consumers may exercise theirdeletion right by emailing us at [email protected].  
  • Right to Opt Out. We do not sell Consumers’ Personal Information for monetary payments. However, the definitions of “personal information” and “sale” under the CCPA are broad. Because of the breadth of these definitions under the CCPA, we have provided an opt-out mechanism. Consumers may exercise their opt-out rights by emailing us at [email protected].
  • Right to Opt In. We do not have actual knowledge that we sell the Personal Information of minors under the age of 16. But in the event that occurs, Consumers who are at least 13 years of age and less than 16 years of age, have the right to opt in to the sale of their Personal Information. The parents or guardians of Consumers who are less than 13 years of age have the right to opt in to the sale of their minor child’s Personal Information. Consumers or their parents or guardians may submit opt-in requests at [email protected].
  • Non-Discrimination. We may not discriminate against Consumers because they exercise any of their rights under the CCPA, including, but not limited to:
    • Denying goods or services.
    • Charging different prices or rates for goods or services, including the use of discounts or other benefits or imposing penalties.
    • Providing a different level or quality of goods or services to you; or
    • Suggesting that Consumers will receive a different price or rate for goods or services or a different level of quality of goods or services.
  • Limited Right of Job Applicants, Employees, Medical Staff Members, and Contractors. To the extent we collect information about Consumers who are job applicants, employees, medical staff members, or contractors, in their role as such, such Consumers have the right, at or before the point of collection, to know the categories of Personal Information that we will collect or have collected and the purpose for which we will use the categories of Personal Information. 

Visiting the Site From Outside the United States

Dr. Wright is located in the United States. If you are visiting the Site from outside the United States, please be aware that your information may be transferred to, stored, or processed in the United States and maintained on computers or servers located outside your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. By using any portion of our Site, you understand and consent to the transfer of your information to the United States and those third parties with whom we share it as described in this Privacy Policy. 

HIPAA Policies

If you are one of our patients, some of your personal information in our possession is protected health information (“PHI”) protected by the Health Insurance Portability and Accountability Act of 1996, as amended (“HIPAA”), and the applicable provisions of the Health Information Technology for Economic and Clinical Health (“HITECH”) Act. In addition to this Privacy Policy, our HIPAA Notices of Privacy Practices apply to your PHI. 

In collecting Personal Information through our Site, we may also collect PHI. Just as we strive to protect Personal Information, we are committed to protecting your PHI. If there is a breach of your PHI, we are required by law to notify you. Your PHI will only be disclosed to you or your personal representative, unless otherwise required or permitted by law. 

Protecting Children’s Privacy

We are committed to protecting children’s privacy on the internet, and we do not knowingly collect personal information from children under the age of 13. We do not knowingly allow children under the age of 13 to communicate with us or interact with our Site. If you are under the age of 13, do not use or provide any information on the Site or on or through any of its features, or make any purchases through the Site. If you believe that we may have collected Personal Information from a child under 13 years of age through our Site, please contact us at [email protected], and we will delete the information as required by applicable law.
